Commercial disputes

Representing businesses and individuals in commercial disputes before the competent circuits, from file review to pleadings and follow-up.

This service covers disputes arising out of commercial dealings: between two businesses, between partners, or between a business and its customer — a disagreement over performance of a supply contract, over an amount claimed, or over the ending of an existing commercial relationship.

The work starts by reading the documents before any opinion is given: the contract and its annexes, the correspondence, purchase orders, invoices and delivery notes, and whatever establishes each party’s capacity. That reading is what determines the correct claim, the correct defendant, and the right procedural route.

The available option, its cost and its limits are then set out in writing. Some files are resolved by a letter or a settlement, faster and cheaper than litigation; others leave no route but the court. The choice stays with the client, once both options have been described plainly.

What this service covers

  • Reviewing the contract, correspondence and documents, and establishing each party’s position
  • Identifying capacity, remedy sought and procedural route before any claim is filed
  • Preparing a formal notice or demand letter where that serves better than litigation
  • Statement of claim, responsive memoranda and replies to defences
  • Attending and pleading before the competent circuit and following the hearings
  • Exploring settlement at any stage where it serves the client better

Where the work stops

  • No outcome is promised and no estimate of winning is given
  • Work does not start before a conflict-of-interest check and a written fee agreement
  • No detailed opinions are given on a matter already before the courts to anyone but the client

What to prepare before we start

  1. The contract, its annexes and any later amendment
  2. Invoices, purchase orders and delivery or receipt notes
  3. A statement of account tying every amount to its source and date
  4. The correspondence between the parties, in date order
  5. The other party’s commercial registration and the capacity of whoever signed for it

How a request is reviewed

  1. First contact
  2. Scope and conflict check
  3. Agreement on service and fees
  4. Work begins
